Professional Visas H1B

Long Island H1B Visa Attorney · Commack, New York, Work Visa Lawyer

Sometimes employment pools do not provide job candidates that match an employer’s needs. Under such circumstances, U.S. employers can look for foreign candidates that meet their job specifications and sponsor an H1B visa petition for a foreign employee with specialized skills. Examples of such specialized professionals include computer programmers, engineers and scientists, to name a few.

About the H1B Visa

An H1B visa allows foreign workers to enter the United States for a limited time. An employer must sponsor the individual who must also meet H1B requirements. Requirements for obtaining an H1B visa, include:

  • A United States employer must offer the individual a specialty occupation involving special skills in certain fields
  • The employer must prove that the same occupation is offered to U.S. nationals
  • The applicant must have a bachelor’s degree or equivalent experience

Applying for H1B Status

The United States Customs and Immigration Services (USCIS) establishes a cap on H1B visas every year, which means there are a limited number of H-1B visas allotted for working professionals. The application process begins in April and employment based on the visa begins in October of the same year. When you turn to the Law Offices of William A.
